Congress MP Abhishek Manu Singhvi raised the issue of gambling law in the Rajya Sabha. He argued that there is a distinction between the games of chance and games of skill. He said that the government has no jurisdiction to ban games of skill. MP Singhvi raised the question of “government policy on online gaming and betting.” 

According to the records, for a petitioner company, Singhvi once appeared before the Karnataka High Court to challenge the constitutional validity of the Karnataka Police Act 2021. The state government in Karnataka has put a ban on online gambling and betting under the Karnataka Police Act, 2021. 

Singhvi said that games of chance and games of skill are different, and hence the government should regulate games of chance, but they have no jurisdiction to ban all games of skill. Earlier in the All India Gaming Federation Vs. State of Karnataka case, Singhvi appeared for GamesKraft Technologies Private Limited. This is the parent company of RummyCulture, which is an online gaming app. 

After a month of that case, Singhvi asked the following things in Rajya Sabha:

  • What are the reasons for not differentiating between games of skill and games of chance? 
  • What are the details of advisory on advertisements on fantasy sports? 
  • What is the policy position of the Ministry on the categories games of skill and games of chance? 

However, many experts and ministers are not so happy with these questions raised by Singhvi. Former Secretary-General of Lok Sabha, PDT Achary said that what MP Singhvi is doing is certainly improper as it may not come under the “conflict of interests.” 

PDT Achary said that there is no rule that allows a member to ask questions or ask supplementary questions (on the basis of conflict of interest) in the House. He said that if a member has a direct interest in the questions related to matter in Parliament, then it can be a question of impropriety.

He reminded the rules of conduct and etiquette of Rajya Sabha, which says that the private financial interests of members and their immediate family members should not come in conflict with the public interest. In case any such conflict occurs, then members should solve it in a way so that the public interest is not affected. 

However, Singhvi denied such conflicts, and he said that he never appeared for any gaming company that deals with fantasy sports except for rummy operators. He clarified that he has only appeared on the legal point of view of games of chance versus games of skill which was only for rummy operators. MP Singhvi also added that he is engaged by different solicitors as a senior counsel, and he never deals with clients and does not know about them. 

MP Singhvi defended himself by saying that his question was just to clarify the subject of policies on games of skill and games of chance. Aside from Karnataka and Madras, many states are banning online gaming activities within their territories. Such bans have high stakes for the online gaming industry.

Delhi Police arrested sixteen people, including three chartered accountants under section 3 and section 4 of the Delhi Gambling Act. 

The police have recovered 37 playing bricks, 1000 playing chips, and a cash amount of Rs. 1,95,000 from the sixteen accused persons. On Thursday, the South Delhi Police busted a huge gambling racket of sixteen individuals who are identified as Ankur Bindal (30) and his father Manish Bindal (55), Prashant Goyal (43), who owns a transport company, Vivek Jain (28) who is the son of an ACP in Delhi Police, a chartered accountant Aakash Sarda (30).

Other accused are Abhishek Sharma (34), Sajan Mukhia (27), Moksh Arora (31), who is a steel trader; Sahil Kumar, who is preparing for competitive exams; Lalit Khanna (39), owner of a consultancy firm, Sachin Gupta (44) who owns a printing firm, Kartik Kalla (48) who is the creative head at a radio firm and other private company employees Damanjeet Sodhi (43), Shashank Jain (32), Himanshu Jain (34) and Arjun Arora (58).

The police had received information about the operations of the gambling racket in M-Block, South Extension. A team formed to bust the gambling racket arrived, thereby laying a strategic trap and raiding the place where sixteen people were found involved in gambling. The government has been making efforts to prevent gambling from the state. 

“The Police acted immediately after receiving the information, and as per the direction of officers, a team was formed and sent to bust the gambling racket at the place. The team raided sixteen people who were found to be involved in gambling,” said Benita Mary Jaiker, DCP of South Delhi. 

The arrested father-son duo disclosed during the investigation that they have been running the casino since April this year. They confessed that they had also given protection money to the local police. The accused individuals have also disclosed the name of police personnel, who was then identified by the investigation team. 

Gambling and betting are illegal in many Indian states. According to the Public Gambling Act of 1867, running or being in charge of a public gambling house is prohibited in the country. However, there are many illegal gambling and betting operations that police are trying to stop.  

Gambling is a state subject in India. Only a few states like Goa and Sikkim have legalized gambling within their territory. Recently Karnataka has banned gambling and related activities in their state. In India, gambling is considered a state subject which means each state in India can have its own legislation over gambling. Recently, Karnataka has banned online gambling and related activities within its jurisdiction. Several other states have also banned online gambling for curbing the menace of gambling in their states. 

Online gaming has turned into a big addiction. The online gaming sector is similar to the crypto industry. So, the government should impose uniform taxation on online gaming. The government should make a comprehensive framework for the regulation of online gaming,” said Rajya Sabha member Sushil Kumar Modi. 

He raised the issue of gambling by saying that online gaming is a matter of great concern. He said many youngsters are falling prey to it, and hence the central government should regulate gambling throughout the country. Currently, more than 43 crores of Indians are engaging in online games. According to studies and reports, it is expected that this number will increase to 65.7 crores by 2025. Furthermore, the current revenue from online gaming is Rs 13,600 crore which is set to become Rs 29,000 by 2025. 

Rajya Sabha Chairman Venkaiah Naidu supported the demands of Sushi Kumar Modi. Venkaiah Naidu asked Ashwini Vaishnav (Minister of Communications, Electronics and Information Technology) to talk to the Law Minister and take necessary steps. Aside from India, many other countries like China are also troubled with children’s indulgence in online gaming.

The Bengaluru Police will not take any action against the skill-based gaming platform Dream11 until the court gives orders.

However, the law has excluded lottery and betting on horse races. Recently, the Karnataka government has given a relief or extension in the case of Dream11 operations in Karnataka. The High Court has ordered the Bengaluru police not to take any coercive action against the fantasy sports platform Dream11 until the court gives the orders.

After the state amended the Karnataka Police Act 1963 and introduced a new online gambling law, gaming companies like Dream11 suspended their operations in the state. These companies have stopped offering their skill-based gaming products to the players in Karnataka. 

Dream11 came in the news when a state resident had filed a complaint against the company that the gaming platform was violating the new gambling law by the government. According to the Karnataka Police Act 2021, “online games like poker, online chess, fantasy sports or bridge that involve real money gaming components are under the risk of getting banned in the state.” 

Many other gaming startups and companies are at the risk of getting banned. Gaming companies violating the law might face up to three years in jail and a penalty of up to INR 1 lakh.

The Karnataka state government informed the High Court that the law banning all gambling-related activities is social legislation. Advocate General Prabhuling K Navadgi has expressed his views about the Karnataka Police Act 2021 that the object of this enactment is to prohibit activity that is injurious to public health and order. 

The Karnataka government had banned all forms of gambling within their jurisdiction. While the authorities are praising this move by the government, many players and gambling operators have criticized this decision by the government. Several gambling operators have stopped offering their products to the players in Karnataka. 

“Online gambling is a bigger menace than alcohol. Gambling is the biggest menace that we are facing today,” defended the Advocate General addressing the division bench of Justice Sachin Shankar Magadum and Chief Justice Ritu Raj Awasthi. The advocate general called the new gambling law social legislation and gambling a bigger menace. 

Karnataka Police Act 2021

The Karnataka Police Act 2021 prohibits all forms of gambling activities in the state. The recent bill has amended the Karnataka Police Act 1963. The act has made gambling a non-bailable and cognizable offence within the boundaries of Karnataka. The state government has amended the law to remove the impact of gambling in society. 

Although the law has been amended, there have been many discussions regarding the implementation of the law. Many gambling operators and players were afraid that the law might also put a ban on the “games of skill.” However, the advocate general has cleared this confusion in the recent division bench. 

Advocate General Defended The State Legislature

Advocate General Prabhuling K Navadgi has defended the state legislature by saying that there is not any ban on games of skill. He expressed his views about cricket betting, which is a huge market in the country. The advocate general has said that the recent Karnataka Police Amendment is not disproportionate legislation. He pointed out the number of criminal cases that are registered against gambling and related activities in the state of Karnataka. 

He also clarified that wagering money on games of skills like Cricket is also a part of gambling. After a tremendous amount of study, the amendment has been made, and the legislation is a perfect way to curb the menace of online betting and gambling in the state. 

Karnataka Police Act 2021 came into force on October 5, and it prohibits all forms of gambling or betting, whether it is in the form of tokens or money. This legislation has banned virtual currency, electronic means, or electronic transfer of funds related to any game of chance. The law does not state any ban on betting on lottery or horse races within the state.
